Availability and Delivery times
The products on our website are always in stock, barring circumstances beyond our control.
Delivery times can range from 24 hours to 5 business days, depending on the country of destination. Different payment and delivery methods may affect the delivery time. For example, deferred payment methods, such as bank transfer, may affect the dispatch date. In such cases, the order will be processed upon receipt of confirmation that the payment has been credited to our bank account.
Receiving your purchases
You can check the status of your orders at any time in your ACCOUNT, where you will find the most up-to-date information on your order.
Acceptance and Collection subject to reservation
Upon delivery of the goods, the customer is obliged to check:
· that the number of packages delivered corresponds to that indicated on the consignment note;
· that the packaging is intact, undamaged, not wet and not otherwise tampered with;
· that no sealing materials other than tape bearing the “Omkafè” logo have been used.
If the packaging shows even the slightest sign of damage and/or the number of packages delivered differs from the expected number, the customer must immediately raise an objection with the courier regarding these discrepancies. To this end, you must write “ACCEPTED SUBJECT TO RESERVATION” on the courier’s delivery receipt, stating the reason for this reservation.
Every courier is obliged to accept this acceptance subject to reservation. Should the courier refuse to accept the parcel subject to reservation, please report the issue encountered upon receipt to Omkafè Customer Services. If the packaging shows any external damage (holes, folds, dents, cuts, tears, etc.), you should take a photograph of the packaging before opening it. This is required for any refund claims to be made against the courier.
Please note: making a general reservation or a reservation without adequate justification will result in the damage NOT being covered by the insurance. Once the courier’s document has been signed, the customer may not raise any objection regarding the external condition of the goods delivered.
Incorrect or non-compliant products.
If, upon opening the parcel, you realise you have received products other than those ordered, please send an e-mail to Omkafè Customer Services within 7 (seven) days of receipt, noting the order number, product code and description of the item you received in error. We may also ask you to provide photographs of the packaging.
Transport costs
The transport costs are calculated primarily on the basis of the weight and/or volume of the products purchased. The breakdown of the costs will be updated in your basket automatically as you make your purchases.
What is the right to withdraw?
The right to withdraw is a consumer protection measure. Omkafè allows you to change your mind about a purchase and to cancel the contract within 14 days of receiving the product. You will receive a full refund of the amount spent at the time of purchase.
To whom does the right to withdraw not apply?
The Right to Withdraw is governed by the Consumer Code and applies only to remote sales between the seller (omkafe.com) and private, non-professional consumers.
Shipment costs: who pays?
Delivery costs (from us to you): we will refund the full cost of the product plus the standard shipment costs you paid to receive the item.
Return costs (from you to us): the costs of returning the product to our warehouse are borne by the consumer, unless the product arrived damaged or was the wrong item.
Omkafè accepts no liability whatsoever for damage to, or theft or loss of, goods returned by means of uninsured shipments. The costs of returning the goods and the method of return are the customer’s responsibility; the customer will not be compensated should the goods be lost or damaged.
Purchased goods must be in perfect condition, packed in their original packaging and complete with any manuals, with nothing missing. Otherwise, Omkafè will deduct a percentage of between 10% and 80% of the current value of the goods, as the product itself cannot be resold as new.
How do I exercise my right to withdraw?
To exercise your right to withdraw within fourteen (14) days of delivery of the goods, you must notify Omkafè that you wish to exercise this right by following this simple procedure.
1. CLICK HERE TO WITHDRAW FROM THE CONTRACT
2. Enter the details of the delivery note, including your first name, surname and customer number and IBAN (International Bank Account Number), to be used for the refund.
(The system will immediately send you an automatic confirmation receipt showing the date and time of receipt.)
3. Keep the product in its original packaging; the product must still be sealed and undamaged.
4. Return the product within 14 (fourteen) calendar days to: Omkafè srl - Via Aldo Moro 7, 38062 Arco (TN), Italy.
5. You will receive your refund promptly
When will the refund be processed?
Once the product has been received and the condition of the goods verified, Omkafè will issue a credit note for the value of the goods accepted by Omkafè. Within 14 (fourteen) business days, the credit note will be refunded by bank transfer.

The contents of the website (text, graphics, images and animation) are protected by copyright: it is therefore prohibited, amongst other things, to reproduce or publish them in any form without the written authorisation of Omkafè.
The following Terms and Conditions of Sale apply to all purchases of products made via the website.
1. Sphere of application and finalisation of the contract
1.1. The offer and sale of products on the website constitute a remote contract governed by Articles 49 et seq. of Italian Legislative Decree No. 206 of 6 September 2005, as amended by Italian Legislative Decree No. 21/2014 (“Consumer Code”), and by Italian Legislative Decree No. 70 of 9 April 2003, containing the regulations on e-commerce.
1.2. The purchase of products on the website is permitted only with regard to persons who, at the time of placing the order, have reached the age of 18 (eighteen). By purchasing on the website, the customer therefore declares that they are of legal age. If the customer is not of legal age, Omkafè will not accept their order.
1.3. A “customer” is the person (natural or legal) who makes a purchase on the website, accepting the Terms and Conditions of Sale (hereinafter, the “customer”).
1.4. Before proceeding with a purchase, the customer is required to read the Terms and Conditions of Sale and accept them by ticking the box provided. At the time of purchase, therefore, these Terms and Conditions of Sale are deemed to have been generally and fully accepted, also with regard to the sections referred to herein via direct links to other sections of the website. In any event, the Terms and Conditions of Sale are made available to the customer by Omkafè in the “Terms and Conditions” section of the website and may be saved.
1.5. The customer undertakes to check the accuracy of the details contained in the order confirmation e-mail and to promptly notify Omkafè of any errors or omissions.
1.6. The applicable Terms and Conditions of Sale are those in force as of the date the purchase order is forwarded. They can be amended at any time by Omkafè. Any amendments shall be in force as from the moment of their publication on the website. Before ordering, customers are therefore invited to regularly visit the website to check the Terms and Conditions of Sale.
2. Purchases on the website
Products may be purchased on the website either after registering or as a “Guest”, and this is permitted both for customers who are consumers and for those who are not.
Pursuant to Article 3.1, letter a) of the Consumer Code, a consumer is a natural person acting for purposes unrelated to any business, commercial, artisan or professional activity they may carry out.
3. Information relating to the finalisation of the contract
3.1. In accordance with Italian Legislative Decree No. 70 of 9 April 2003, containing provisions on e-commerce, Omkafè informs the customer that: to purchase one or more products on the website, the customer must complete an electronic order form and submit it to Omkafè on-line, following the instructions that will appear on the website from time to time. Before submitting the order form, the customer must accept the Terms and Conditions of Sale. Once the order form has been registered, Omkafè will send the customer an order confirmation to the e-mail address provided, containing: information regarding the essential features of the product purchased, a detailed breakdown of the price, the payment method used, delivery charges and any additional costs. The order form will also be stored in Omkafè’s electronic database for the time necessary to fulfil the order and, in any event, in accordance with the legal timescales.
4. Product availability
4.1. Omkafè constantly checks that all the prices indicated on the website are correct, without however that this may guarantee the absence of errors. Should an error in the price of the product be detected, Omkafè shall provide the customer with the possibility to reconfirm the purchase of the products at the correct price or cancel the order.
4.2. In the event that several users purchase the same product at the same time, it may occur that it is no longer available, despite the purchase order having been sent. Omkafè therefore reserves itself the right to notify the customer if the product is unavailable. In such cases, Omkafè will terminate the contract and the purchaser who has made the payment (see the “Payment Methods” section) will be promptly refunded the full amount paid.
5. Product information
5.1. Each product comes with a description setting out its main characteristics. Our coffees are also accompanied by a dedicated fact sheet describing their origins and aromatic properties. However, these may vary depending on the extraction method, the parameters used for extraction, the characteristics of the water and the use of filtering systems. Omkafè will do its utmost to ensure that the product images published on the website represent the products on sale as faithfully as possible. The colours of the products, however, may differ from the actual colours due to the settings of the IT systems or computers used by users to view them. Furthermore, the product images shown in the Technical Specifications may differ in size or in relation to any accessory products; the images may also differ with regard to certain details regarding colour or variant. For the purposes of the purchase contract, the product description contained in the order form submitted by the customer shall prevail.
6. Prices
6.1. All prices published on the website are in Euros and include VAT and taxes. Delivery charges, which may vary depending on the chosen delivery method, location, quantity of products or the payment method used, will be specifically indicated (in Euros) in the order summary, as well as in the order confirmation e-mail.
6.2. Omkafè reserves itself the right to change product prices at any time. It is understood that the price of the product charged to the customer will be that shown on the website at the time of placing the order, and that any subsequent changes (whether increases or decreases) after the order has been submitted will not be taken into account.
7. Purchase orders
7.1. In the order confirmation e-mail, in addition to the information referred to in Article 3.1 above, the customer will also find the “Order Number”, which they must then use in any subsequent correspondence with Omkafè, as well as a summary of all the customer’s details included in the order. The customer undertakes to check that this information is correct and to promptly notify Omkafè of any corrections via Omkafè Customer Services.
7.2. The customer who has made the purchase may access their order and check its status by logging into their personal profile in the relevant section of the website.
8. Payment methods
Omkafè makes the following payment methods available for purchases:
· Credit Card
· PayPal
· Bank transfer
The payment methods actually available to the customer for each individual product will, in all cases, be indicated during the purchase process.
9. Delivery methods, charges and terms
9.1. Products are delivered exclusively to the countries listed, to the delivery address specified by the customer on the order form.
9.2. Delivery charges are payable by the customer, unless a promotional code or an active promotion on the website is available. The total amount of delivery charges may vary depending on the delivery method and, above all else, on any additional products the customer decides to purchase. The exact amount of the delivery charges will therefore be shown in the shopping basket and in the order summary before the order is submitted.
9.3. In the order summary – and, therefore, before the customer submits the order – the total price of the order will be shown, with delivery charges and any other additional costs listed separately. This total, which will also be indicated to the customer in the order confirmation e-mail referred to in Article 3.1 above, shall constitute the total amount payable by the customer in respect of the product. The customer is not required to pay any amount in excess of this sum. For every purchase made on the website, Omkafè issues an invoice. The invoice will be issued and sent in accordance with the applicable legal provisions. The information provided by the customer when submitting the order via the website, which the customer guarantees to be true and accurate, shall be used for the purposes of issuing the invoice. No changes to the invoice will be possible once it has been issued.
9.4. Products dispatched are checked and handed over to the courier in perfect condition. Omkafè shall not be liable for any damage and cannot undertake to replace the goods unless such damage is reported at the time of accepting the delivery by noting the complaint on the courier’s delivery note.
Upon delivery, the customer is obliged to check:
- that the number of packages being delivered corresponds to that indicated on the consignment note sent in advance via e-mail;
- that the packaging is completely intact, undamaged, uncrushed, unpierced, dry, untorn and not altered in any way, including the sealing materials.
Customers are therefore advised, in their own interest, to report any irregularities in the packaging or discrepancies in the number of parcels by noting an appropriate “SPECIFIC RESERVATION” or by INDICATING ON THE DELIVERY NOTE (where a signature is required) a description of the type of damage to the packaging observed at the time of collection. We strongly recommend that you keep the document attached to the order in order to report any discrepancies with regard to the delivery.
Should the courier arrive with an electronic terminal, you will still need to tick the “reservation” box and select the issue found with regard to the packaging from among the available options.
Acceptance of the goods without reservation or with a general reservation of inspection does not, in fact, entitle the customer to take legal action against the courier, nor does it allow Omkafè to take such action in the event of loss of or damage to the goods, with the exception of partial loss or damage not recognisable at the time of delivery (concealed damage), in relation to which please refer to Article 12.
9.5. The customer is required to check immediately that the product is in good working order and conforms to the order at the time of delivery. In the event of defects, visible damage or non-conformity, the customer must report this promptly to Omkafè no later than 7 (seven) calendar days from the date of receipt of the product (including the day of delivery), by contacting Omkafè Customer Services.
IMPORTANT: you must keep the original packaging in order to return a non-compliant product.
To submit a claim, the customer must provide the following documentation:
Order number or sales document
Photograph of the outer packaging
Photograph of the damaged part
A copy of the receipt, if available, bearing a specific reservation clause
Claims submitted after this deadline or without the complete documentation cannot be considered, except as envisaged in Article 12 and its sub-paragraphs.
9.6. The customer duly notes that the acceptance of the product is their precise obligation deriving from the purchase agreement. Should the customer require as such, they may reschedule the delivery for another date via the courier’s own platform. In the event of a failed delivery due to the recipient’s absence at the address specified on the order form, the parcel will be held at the courier’s depot.
9.7. The dispatch period – that is, the time from when the courier takes charge of the product – and the delivery period commence from the date of receipt of payment for the purchased product.
Should Omkafè, in order to verify the customer’s identity and their authorisation to make a payment, request additional information (for example, a landline telephone number, via email), the dispatch times—that is, the time at which the courier takes charge of the product—will commence from the date of receipt of the documentation or from the date of confirmation of the transaction by the fraud prevention centre.
Should the purchased product be delivered later than the specified delivery dates, the customer may contact Omkafè Customer Services, which will promptly investigate the complaint and notify the customer of the outcome by e-mail.
Under no circumstances shall Omkafè be held liable for any delay, cancellation or failure to deliver where this is due to force majeure or unforeseeable circumstances (including malfunctions or disruptions to the internet and matters for which the customer is responsible).
These general terms and conditions set out the full extent of Omkafè’s liability in respect of the items sold on the website, with the exclusion of any other warranties, conditions and terms, whether express or implied, established by law, including those relating to the quality or fitness of the items for specific purposes, without prejudice, however, to those warranties which, by law, cannot be waived, with particular reference to the provisions of Article 1229 of the Italian Civil Code and in relation to liability for damage caused by defective products and consumer protection.
11. Product returns and online Right to Withdraw
11.1. Pursuant to Article 54 et seq. of the Consumer Code, a customer acting as a consumer is entitled to withdraw from the contract for the purchase of the product, without penalty and without having to specify the reason, within 14 days of receipt of the product (or, in the case of multiple items ordered by the consumer in a single order and delivered separately, from the day on which the consumer or a third party, other than the carrier and designated the consumer, takes physical possession of the last item).
11.2. Customers wishing to exercise their right to withdraw must use the appropriate WITHDRAWAL FORM within 14 days of the date of receipt of the product.
11.3. In the notice of withdrawal, the customer must provide the details of the delivery document (invoice number), first name, surname, customer number and IBAN (International Bank Account Number).
Once communication of withdrawal has been received, the system will immediately send an automatic confirmation receipt showing the date and time of receipt.
The product must be returned to Omkafè within 14 (fourteen) calendar days of sending the notice of withdrawal. For the purposes of calculating the deadline, the product is deemed to have been returned at the moment it is handed over to the pertinent post office or to the courier.
11.4. The essential integrity of the goods is an essential condition for exercising the right to withdraw. The product must therefore be stored with due care and returned intact, complete in every respect (including packaging and any documentation and accessories: manuals, cables, etc., where applicable), free from signs of damage, wear and tear or dirt, and consequently must not be such that it can no longer be regarded as intact and saleable.
Pursuant to Article 59 of the Consumer Code, the right to withdraw is therefore expressly excluded for the «supply of sealed goods which are not suitable for return for reasons of hygiene or health protection and have been opened after delivery». Removing the seal or opening the packaging of a food product compromises hygiene and health standards, making it impossible to return the item.
11.5. Returned goods must be in perfect condition, packed in their original packaging or other suitable packaging and complete with any manuals, with nothing missing. Otherwise, subject to communication to the customer, Omkafè will deduct a percentage of between 10% and 80% of the value of the goods at the time of return, as the product itself cannot be resold as new.
11.6. If the product’s serial number is printed on the packaging – as is the case, for example, with electronic goods – the packaging forms part of the product and, consequently, the product must be returned in its original packaging, which must be placed inside further packaging, as no other labels or tape may be affixed to it. Furthermore, the right to withdraw applies to the product in its entirety. It cannot be exercised in relation to parts and/or accessories of the product.
11.7. The costs for returning the product are payable by the customer. The return is carried out under the customer’s full responsibility until Omkafè confirms receipt of the product. The customer is liable for any damage the product may sustain during transport.
11.8. Provided that the customer has complied with the procedures, terms and conditions for exercising the right to withdraw, Omkafè will, within 14 working days of receiving the returned goods, refund the amounts paid by the customer for the product, with the exception of the costs for returning the goods to Omkafè’s premises, which shall be borne by the customer. The refund will be made by bank transfer to the bank coordinates provided by the customer in the notice of withdrawal.
11.9. Should the product be damaged during transport, Omkafè will notify the customer of the incident, to enable them to exercise the rights to which they are entitled under the transport contract. In this case, the product will be made available to the customer so that they may regain possession of it; at the same time, as the product is no longer intact, the request for withdrawal will be refused.
11.10. As envisaged in the legislation on withdrawal (EU Directive 2011/83/EU and the Italian Consumer Code), this applies only to consumers located within the European Union.
11.11. Should the right to withdraw not have been exercised in accordance with the provisions of Articles 52 et seq. of the Consumer Code and, in particular, should the product not be intact in all its parts and/or accompanied by its accessories and/or elements that form an integral part thereof (e.g. cables, batteries, manuals, etc.) and/or is missing its original packaging – where this forms part of the product – or where the product is damaged or has been used by the customer beyond the limits of normal diligence, this will not result in the termination of the contract and, consequently, will not entitle the customer to a refund of the amount paid for the product. The product will remain care of Omkafè, available for collection by the customer, which must take place at the customer’s own expense and diligence.
11.12. The consumer is liable only for any reduction in the value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning. To ascertain the nature, characteristics and functioning of the goods, the consumer may only handle and inspect them in the same way as they would be permitted to do so in a shop. Consequently, during the withdrawal period, the consumer must handle and inspect the goods with due care.
12. Legal Warranty of Compliance
12.1. Warranty for coffee and other food products
Omkafè guarantees the quality of its coffee and other food products against any defects in materials and workmanship until the expiry date stated on the product itself, provided that the products are handled and used in accordance with the instructions, labels and/or other documentation supplied by Omkafè. It is understood that, once opened, food products must be consumed by the date shown on the label and stored in accordance with the instructions provided.
12.2. Machine Warranty
The coffee machines sold are covered by the statutory warranty against lack of conformity pursuant to Italian Legislative Decree No. 24/2002, as amended, and Italian Legislative Decree No. 206/2005.
The Statutory Warranty is valid for 2 (two) years as from the date of delivery and covers any lack of conformity in the product existing at the time of purchase, in accordance with Article 129 of the Consumer Code. If the lack of conformity becomes apparent within one (1) year of the product’s delivery date, it is presumed – unless proven otherwise – that it already existed at the time of delivery.
In the event of a lack of conformity, the customer may, at their discretion, request that the product be repaired, replaced or that the contract be terminated, at no cost, unless the chosen remedy is objectively impossible or disproportionately onerous compared to the alternative.
In order to make a claim under the Statutory Warranty, the customer must report the fault by writing to Omkafè Customer Services.
Upon receipt of the report, Omkafè will arrange for the collection of the defective product at its own diligence and expense. Products must be returned with all accessories and items included in the packaging, and must be suitably packed.
Omkafè will repair or replace the product within a reasonable period of time.
The Warranty does not apply in the event of a fault caused by: failure to follow the instructions for use and maintenance set out in the booklet supplied with the product; negligence or carelessness in use; incorrect installation; maintenance or repairs carried out by unauthorised personnel and/or the use of non-original spare parts; damage caused during transport, unless carried out by Omkafè; or defects caused by events not attributable to non-conformities of the product; or the insufficiency, inadequacy or non-conformity of the electrical installations to which the product is connected for its use.
This Warranty does not cover parts subject to normal wear and tear, any accessories or consumables, unless the relevant faults are attributable to defects in terms of conformity.
13. Privacy
The personal data requested when placing an order is collected and processed for the purpose of fulfilling the customer’s specific requests and will under no circumstances, for any reason whatsoever, be disclosed to third parties.
Omkafè processes its customers’ personal data in accordance with the provisions of the law, in the manner and for the purposes specified in the Privacy Policy published here.
The data controller is Omkafè srl – Via Aldo Moro, 7, 38062 Arco (TN), Italy.

14. Complaints
Any complaints must be addressed to Omkafè srl – Via Aldo Moro 7, 38062 Arco (TN), Italy, or submitted via the website by accessing the Omkafè Customer Services section.
15. Jurisdiction
These Terms and Conditions of Sale are governed by Italian law and, in particular, by Italian Legislative Decree No. 206 of 6 September 2005 (the so-called “Consumer Code”), with specific reference to the regulations concerning remote contracts, and by other applicable legislation in Italy relating to sales outside business premises.
For civil disputes, exclusive jurisdiction lies with the court of the customer’s place of residence or domicile, in accordance with the provisions of the Consumer Code.
